FLORIDA SHORT SALES & FORECLOSURES
WHAT IS A SHORT SALE: A Short Sale occurs when a property owner owes more on the property than the property is currently worth. Selling the property at current market value would create a shortage unable to satisfy the loans (liens) against the property.
The seller must negotiate with their lender to accept less than is owed to the lender for the lender will release the liens against the property so that it may be sold to a new buyer.
The lender is NOT a party to the transaction. You may see the following phrase: "Subject to third part approval" what this means is approval of the seller's lender is necessary to release the liens secured by the mortgage. The seller is the homeowner of record not the bank.
A FORECLOSURE: Is a legal action resulting from a borrower defaulting on their repayment obligations to a lender. The lender files a legal action against the borrower. Florida is a judical state, and requires the court's consent to foreclose.
Once the petition is granted by the court, the property will revert to the lender.
REO- Real Estate Owned Property is owned by a lender. Once a lender takes possession of the property, the value is analysed, and it is marketed for sale by the lender and is owned by the bank. These properties typically are sold "As-Is" and may need repairs. The lenders make no warranties on condition and the buyer is responsible for paying for inspections and closing costs. "As-Is" means what it implies. A home inspection is highly recommended before purchasing property in Florida.
